The NOVA funds are not 18th amendment funds – they are not gas tax dollars which are restricted by the 18th amendment. The 18th amendment refers to on-road gas tax. Off-road uses of gasoline are not subject to the tax, so it’s refunded, and some portion of what’s not refunded (because people don’t claim it) gets used for NOVA. Boaters can claim refunds of their gas tax, too. This account was created when off-road vehicle users volunteered to waive their legal right to a fuel tax refund in exchange for a self-directed state account to provide funding for programs that benefited off-road vehicle activities.

Again they make it sound as though there is no legal right or allocation of the subject funds. It is BS for them too even think that these funds are not an allocated tax. HB 2489 of 2004 clearly executes a division of this TAX FUNDING for a specific use. They keep saying that the money is not covered by the 18th amendment, that again is missleading... it is covered under law that any and all taxation is to have representation so if there is no representation for this money than it shouldnt exist. It would be in clear violation of the law. They treat it as a general fund... how I dont really know? Like Represenative Cary Condotta stated, "It is Theft and it is illegal"
